Booking Form and Agreements

1.     Booking.

       The undersigned desires to attend and participate in the 2006 Food Writers’ Retreat (the

       Retreat)  in Burgundy and in that connection agrees to the following terms:

 

2.     Cost. The total cost of the Retreat is $3,200 per person (the “fee”). That includes the writing

Program, lodging at Chateau du Fey (based on double occupancy) for seven nights, all meals

 Including wine and beverages for seven days, ground transit to and from the Retreat site and Paris, France, transit by autobus during the week, and entry fees to scheduled Retreat events, only. Not included, without limitation are: any form of travel other than transit to and from the site and Paris, any kind of insurance, medical expense, or off-site communication.

 

3.     Payment; Cancellation. The fee is payable by check, VISA or MasterCard. Please send check payable to La Varenne to: Denise Bina c/o Food Writers’ Retreat, P.O. Box 14354, Scottsdale, AZ 85267 <denise-bina@cox.net). To contact her re credit card payment, please call her at 480-419-8506.

       Payment is due, with two  signed copies of the Booking Form as follows:

a.       $1,000 with submission of this Booking Form (Booking Form and Agreements to be

sent to Antonia Allegra via email (antonia@fcs.net) or Fax [707-963-7197] or by USPS:  P.O. Box 663, St. Helena Highway North, St. Helena, CA 94574.)

b.       $2,200 on or before July 1, 2006.

 

On receipt of the two signed copies of this Booking Form as well as payment, A.Allegra will sign and return a copy of the Booking Form to you.

 

Responsibility for payment of the full fee is not subject to termination or cancellation excepting by reason of the material or prospective failure of the Retreat to provide the promised Retreat facilities, or due to cancellation of the Retreat by A.Allegra by reason of either not having at least 10 fully paid bookings by July 1, 2006 or the inability of A.Allegra to attend the Retreat or because of the unanticipated unavailability of necessary facilities at the Retreat site. Upon any such cancellation by A. Allegra, all sums paid shall be refunded in full.

 

4.     Insurance. The Retreat does not provide any trip, health or other insurance, but strongly urges each participant to carefully consider her/his needs for the same.

 

5.     Release and Indemnity. On behalf of myself and my heirs, I expressly agree to indemnify, hold harmless, protect, release and discharge the Retreat and Antonia Allegra (the “Indemnity”) from any and all claims, costs (including attorneys fees), causes of action and liability on account of any loss of or damage to personal property or on account of my personal injury or death arising out of or in connection with my travel to and from participation in the Retreat, whether caused by the act or omission of one or more of the Indemnitees or by any agent, contractor or employee of any Indemnitee or by any third party (even idf any such act or omission is negligent rather than grossly negligent, or as the result of any cause beyond the reasonable control of the Indemnitees such as war, casualty (fire, flood, etc.), theft and labor strikes, etc.

 

6.     Miscellaneous.   This  Agreement  shall be governed by the laws of California and venue for any litigation to enforce it or requiring its interpretation shall be Napa County, California. In any such litigation the losing party shall reimburse the prevailing party’s reasonable attorney’s fees, as determined by the court. Any notice or material communication must be addressed to the intended recipient at her/his address below and sent by prepaid U.S. First Class mail.
